1. Acceptance of terms

By creating a Vita account or otherwise using the Vita app, the website at vitafood.app, or any related services (collectively, the "Service"), you agree to these Terms of Service ("Terms"). If you do not agree, do not use the Service.

These Terms form a binding agreement between you and Vita ("we", "us", or "our"). Together with our Privacy Policy and Cookie Policy, they govern your use of the Service.

2. Eligibility

You must be at least 13 years old (or 16 if you live in the European Economic Area or United Kingdom) to use the Service. By using the Service, you represent that you meet this requirement and that you have the legal capacity to enter into these Terms.

If you are using the Service on behalf of a household or family (e.g., a Family plan), you represent that you have the authority to bind each member to these Terms.

3. Your account

You are responsible for keeping your account credentials confidential and for all activity that occurs under your account. Notify us immediately at support@vitafood.app if you suspect unauthorized access.

You agree to provide accurate, current, and complete information when you sign up and to keep that information up to date.

4. Subscriptions, billing & refunds

Free and paid plans

Vita offers a Free plan and paid subscription plans (currently Pro and Family). Pricing and feature limits for each plan are described on our pricing page and may change from time to time. Existing subscribers will be notified before any price increase takes effect.

Billing through Stripe

Paid subscriptions are processed by Stripe. By subscribing, you authorize us (through Stripe) to charge your selected payment method on a recurring basis (monthly or annually, as selected) until you cancel. Stripe's terms and privacy policy apply to their handling of your payment information.

Free trials

If we offer a free trial, your subscription will automatically convert to a paid subscription at the end of the trial period unless you cancel before the trial ends.

Cancellation

You may cancel a paid subscription at any time from within the app or by emailing support@vitafood.app. Cancellation takes effect at the end of the current billing period; you will retain access to paid features until that date.

Refunds

Subscription fees are generally non-refundable. We may, at our discretion, offer a refund for the most recent billing period if you cancel within 14 days of an initial subscription or renewal and contact us at support@vitafood.app. Where applicable law (such as EU consumer protection rules) grants you a longer cooling-off period or other refund right, those rights apply.

5. Acceptable use

You agree not to:

  • Use the Service for any unlawful purpose or in violation of any applicable law.
  • Reverse engineer, decompile, or attempt to extract the source code of the Service, except to the extent applicable law expressly permits.
  • Scrape, crawl, or use automated means to access the Service in a way that places undue load on our infrastructure.
  • Submit content that infringes the rights of others, contains malware, or is intended to harm the Service or its users.
  • Resell, sublicense, or commercially exploit the Service or the AI outputs without our written permission.
  • Attempt to gain unauthorized access to any part of the Service, other accounts, or our infrastructure.

6. AI output & food safety disclaimer

Read this carefully. Vita uses artificial intelligence to analyze food. AI can be wrong. Vita is not a doctor, dietitian, allergist, or substitute for professional medical advice.

Scan results, "Vita Score" values, ingredient analyses, eco impact estimates, and chat responses are generated by AI models (including Google's Gemini). They may be inaccurate, incomplete, or outdated. Ingredient lists and product formulations change frequently and may not match what Vita reports.

Do not rely on Vita as the sole basis for any decision involving:

  • A food allergy or intolerance, especially a severe or anaphylactic allergy.
  • A medical condition (including diabetes, celiac disease, kidney disease, pregnancy-related dietary concerns, etc.).
  • Religious or cultural dietary requirements that demand certified compliance.
  • Any decision where an incorrect answer could cause harm.

Always read product labels yourself, consult the manufacturer when in doubt, and seek advice from a qualified healthcare professional for medical or dietary guidance. Vita is a tool, not a guarantee.

7. Your content

"User Content" means anything you submit to the Service: photos you scan, dietary profile information, follow-up questions, feedback, and so on.

You retain ownership of your User Content. By submitting it, you grant us a worldwide, non-exclusive, royalty-free license to host, store, transmit, and process it solely for the purpose of operating and improving the Service for you. We do not use your User Content to train AI models, and we do not sell or share it for advertising or marketing purposes.

You represent that you have the right to submit any User Content you provide and that doing so does not violate the rights of any third party.

8. Intellectual property

The Service, including its software, design, the "Vita" name and logo, and all related materials, is owned by Vita and protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for personal, non-commercial purposes in accordance with these Terms.

The "Vita Score" and Vita-generated analyses are produced by our service for your personal use. You may save and share individual scan results for non-commercial purposes; you may not aggregate or republish Vita-generated analyses at scale.

9. Third-party services

The Service relies on third-party providers, including (but not limited to) Stripe (payments), Supabase (auth and storage), Google (Gemini AI), and Vercel (hosting). Your use of those providers, where they make their terms directly applicable, is subject to their own terms of service and privacy policies. We are not responsible for the acts or omissions of any third-party provider.

10. Termination

You may stop using the Service and delete your account at any time. We may suspend or terminate your account if you breach these Terms, if your use of the Service creates legal or security risk, or if we are required to do so by law. Where reasonably possible we will provide notice before suspension.

Sections that by their nature should survive termination (including AI Disclaimer, Intellectual Property, Disclaimer of Warranties, Limitation of Liability, Indemnification, and Governing Law) will continue in effect after your account is closed.

11. Disclaimer of warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE, OR THAT AI-GENERATED OUTPUTS WILL BE ACCURATE OR COMPLETE.

SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF CERTAIN WARRANTIES, SO SOME OF THESE EXCLUSIONS MAY NOT APPLY TO YOU. NOTHING IN THESE TERMS LIMITS RIGHTS YOU MAY HAVE UNDER NON-WAIVABLE CONSUMER PROTECTION LAWS.

12. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, VITA AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATED TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO US IN THE 12 MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR (B) US$50.

13. Indemnification

You agree to indemnify and hold harmless Vita and its officers, directors, employees, and agents from any claims, damages, liabilities, and expenses (including reasonable attorneys' fees) arising out of or related to your User Content, your use of the Service in breach of these Terms, or your violation of any law or third-party right.

14. Governing law & disputes

These Terms are governed by the laws of the State of Minnesota, United States, without regard to its conflict-of-laws principles. Any dispute arising out of or related to these Terms or the Service will be brought exclusively in the state or federal courts located in Hennepin County, Minnesota, and you consent to personal jurisdiction in those courts.

Nothing in this section limits any rights you may have under mandatory consumer protection laws of your country of residence.

15. Changes to these terms

We may update these Terms from time to time. If we make material changes, we will notify you by email or through an in-app notice before the changes take effect. Your continued use of the Service after the effective date constitutes acceptance of the updated Terms.
